The terms governing your use of Treminix Defense services and website.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Treminix Defense LLC ("Treminix," "we," "our," or "us"), a Georgia limited liability company operating under GA Lic. #JPCE-GA-7829. By scheduling a service, signing a service agreement, granting Treminix access to your property, or using our website, you agree to be bound by these Terms.
2. Services
Treminix provides residential and commercial structural pest control services including termite defense (liquid barrier and bait station), cockroach and general pest elimination, fire ant management, mosquito control, rodent exclusion, and stinging insect removal. All services are performed pursuant to GA Lic. #JPCE-GA-7829 and applicable Georgia Structural Pest Control regulations (O.C.G.A. Title 43, Chapter 45).
All services are performed pursuant to a written proposal or work order specifying scope, materials, pricing, and applicable warranties. No service is initiated without prior written Client authorization. Proposals are valid for 30 days from issue date unless otherwise noted. Free assessment inspections are performed without obligation and produce a written findings report delivered to the Client regardless of service decision.
3. Client Responsibilities
To enable effective service, you agree to: provide Treminix technicians with safe, unobstructed access to all property areas specified in the service agreement at the scheduled time; disclose all known property information relevant to pest control, including known structural deficiencies, prior pest treatment history, property age and construction type, the presence of children, pets, or individuals with chemical sensitivities, and any known hazardous conditions; follow all pre-treatment preparation instructions (clearing under-sink cabinets, temporarily relocating aquariums, securing pets); observe re-entry time restrictions stated at treatment completion; report any concerns or adverse reactions within 48 hours; and pay all invoiced amounts within stated terms.
Failure to fulfill these responsibilities may void applicable service guarantees and may result in additional charges for revisit services required by inadequate access or preparation conditions outside Treminix's control.
4. Termite Bond and Warranty Terms
Treminix termite protection bonds are issued under Georgia Department of Agriculture regulations for termite contracts (Ga. Comp. R. & Regs. 40-24-2). Bond terms include: annual inspection visits; written inspection reports documenting the condition of all bait stations and structure perimeter; re-treatment at no additional charge in the event of verified Reticulitermes activity within the protected zone during the bond period; and structural repair coordination for damage attributed to termite activity during active bond coverage.
Termite bonds do not cover: damage that occurred prior to treatment initiation; activity at locations outside the treated perimeter; damage attributable to structural conditions that prevent effective treatment (e.g., untreated earth-to-wood contact that the client declined to remediate despite written recommendation); or activity attributed to Formosan termites (Coptotermes formosanus), which require separate treatment protocols and bond terms. Bonds are renewable annually. Bond lapse periods create gaps in coverage that may affect retreat or repair eligibility.
5. General Pest Service Guarantees
Treminix general pest service programs (Sentinel, Guardian, Fortress) include a between-visit re-service guarantee: if covered pest activity occurs between scheduled service visits, Treminix will return and re-treat at no additional charge. This guarantee requires: the Client is on an active program; the pest activity involves a covered species; and the Client notifies Treminix within 14 days of observation. Re-service is for the same pest category at the same property. Guarantee is void if the Client has made structural modifications or changes that create new entry pathways after Treminix's initial exclusion assessment.
6. Payment Terms
One-time service invoices are due upon completion of service unless alternative terms are specified in writing before service. Program subscriptions are invoiced per billing cycle (quarterly or as specified) and due within 14 days of invoice date. Acceptable payment methods include credit/debit card, ACH bank transfer, and check. Accounts 30 or more days past due are subject to a late fee of 1.5% per month on the outstanding balance (18% per annum). Treminix reserves the right to suspend program service on accounts with unpaid balances exceeding 45 days. Reasonable collection costs including attorney fees may be recovered to the extent permitted under O.C.G.A. § 13-6-11.
7. Cancellation Policy
Program subscription cancellations require 48 hours written notice before the next scheduled service visit. No cancellation fee applies with proper notice. Cancellations received less than 24 hours before a scheduled assessment or service visit may incur a scheduling fee not to exceed $75 for residential properties. Emergency dispatch cancellations received less than 2 hours after dispatch confirmation may incur a dispatch fee not to exceed $150. Termite bonds cancelled mid-period are refunded on a pro-rata basis less a $45 administrative fee.
8. Chemical Safety and Re-Entry
All pest control products applied by Treminix are EPA-registered for their stated use and applied in accordance with label directions by GA-licensed Treminix technicians. Treminix will communicate re-entry intervals, ventilation requirements, and any special precautions verbally at the time of service and in the written service report. Client agrees to disclose changes in household composition (new pets, infants, individuals with medical conditions or chemical sensitivities) before each service visit. Treminix adjusts product selection based on disclosed household conditions — accurate disclosure is a requirement of maintaining the service guarantee.
9. Limitation of Liability
Treminix's maximum aggregate liability to any Client for any claim arising from pest control services is limited to the total fees paid to Treminix for the specific treatment program giving rise to the claim in the twelve months preceding the claim. Treminix shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost income, property damage not directly attributable to Treminix technician negligence, or damage arising from pre-existing structural conditions. Treminix maintains $3,000,000 in commercial general liability insurance and current workers' compensation coverage. Certificates of insurance are available upon written request.
10. Property Access and Safety
Client represents that the property is safe for Treminix personnel to enter and work, including securing dangerous animals, disclosing known structural hazards (unstable flooring, electrical issues, confined space hazards), and ensuring that Treminix technicians are not subjected to harassment or unsafe conditions. Treminix reserves the right to terminate service at properties where technician safety cannot be assured, without penalty or refund for uncompleted services at that visit, pending resolution of the safety concern.
11. Dispute Resolution
In the event of a dispute arising from these Terms or any Treminix service engagement, the parties agree to attempt resolution through good-faith direct negotiation for a period of 30 days following written notice of the dispute. Disputes not resolved through direct negotiation shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules. Arbitration shall be conducted in Atlanta, Georgia. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Either party may seek injunctive or other emergency equitable relief from any court of competent jurisdiction without waiving the right to arbitration.
12. Governing Law
These Terms are governed exclusively by the laws of the State of Georgia, without regard to conflict of law principles. Venue for any legal proceeding not subject to arbitration is exclusively in the state or federal courts of Fulton County, Georgia. Client consents to the personal jurisdiction of such courts.
13. Entire Agreement and Severability
These Terms, together with any executed service agreement or proposal, constitute the entire agreement between you and Treminix concerning the subject matter herein. If any provision of these Terms is held by a court or arbitrator to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force.
